Designs

On behalf of our clients we file and prosecute design applications all over the world. Outside Denmark we work with a network of associates.

Denmark is a European Community member state. Thus, we are able to file design applications directly with the relevant Offices in the case of:

  • National Danish design applications
  • Community design applications (RCD)

Denmark is also a party to the Paris Convention, and we classify according to the Locarno Classification.

Filing Requirements

Danish or Community Design (RCD) Application

  1. Full name(s) and address(es) of applicant(s)
  2. Full name(s) and address(es) of designer(s)
  3. Representations – drawings or photographs (CD up to 7 views per design)
  4. Priority: date, number and country (certified copy of convention appln. on request only in Denmark, but required for a CD; late filing possible)
  5. No other formal documents required

Examination and procedure

A Danish design application is examined for formalities, only, and to verify that the design is not contrary to public order or morality. Examination on novelty is only carried out on request (before or after registration with the Danish Patent Office).

Multiple design applications available, provided that the products concerned belong to the same Locarno Class, i.e. that they pertain to the same type of goods.

If the application meets the formal requirements, the design is registered (2-4 weeks after the application date), and the registration is published in the Danish Designs Journal. Upon request, publication may be delayed for up to 6 months from the application date or from the priority date.

Registration is granted for 5 years from the registration date. Renewable in blocks of 5 years up to a maximum of 25 years.

A Community design (RCD) application is mainly checked for formalities. Thus, there is no substantive examination, except to verify that the design is not contrary to public order or morality.

Multiple design applications available, provided that the products concerned belong to the same Locarno Class, i.e. that they pertain to the same type of goods.

If the application meets the formal requirements, the design is registered, and the registration is published in the Community Designs Bulletin (4-6 weeks after the application date). Upon request, publication may be delayed for up to 30 months from the application date or from the priority date.

Registration is granted for 5 years from the registration date. Renewable in blocks of 5 years up to a maximum of 25 years.
